About Open Arbitration

Open Arbitration is a non-profit that makes arbitration work the way it was designed to — with full information on both sides, fair process, and public accountability. We build the tools and publish the data that support Informed Consent and Contractual Integrity in pre-dispute arbitration.

The platform is owned and operated by Make Sure It Happens Inc. (www.msih.org), a 501(c)(3) non-profit organization dedicated to transparency and fair process in arbitration markets.

Our Core Initiatives

For Parties in Arbitration

  • Private NDA Modification Proposal: A blank bilateral template a party completes and mails directly to the other party. No third-party administration.
  • Case Management: A system to document and manage disputes from filing through final award.
  • Clause Database: A public, searchable database of pre-dispute arbitration clauses and opt-out policies.
  • Arbitration Guide: A plain-language resource for understanding arbitration process and procedure.
  • Zero Trust Case Content: How dispute notes, letters, and files are encrypted in your browser so staff cannot read them.

Policy & Market Reform

  • Policy & Research: Evidence-based research on arbitration clause terms, outcome disclosure, and neutrality standards for policymakers and institutional stakeholders.
  • Annual Conference: Convening researchers, attorneys, regulators, and corporate stakeholders to advance transparency standards.
  • Legislative Toolkit: Model bills, communication resources, and engagement tools for legislators at the federal and state level.
